At the purchase price of: ____________________________________ in US Dollars. Purchaser is responsible for any and all costs involved in obtaining said puppy, including but not limited to: Transportation and Crate.

* We cannot foresee the future and therefore it is understood that we cannot guarantee this Whippet to complete his/her title(s).

Purchaser and breeder promise and agree upon the following conditions for the canine puppy described as follows: 

1) Breeder agrees to provide documentation of current vaccinations and other pertinent medical treatment for the puppy. All puppies are warranted to be of good health at the time of sale (subject to any health problems or defects the purchaser agrees to accept). Any claims of health problems, not due to the purchaser's neglect or mistreatment of the puppy, when sold must be supported by a signed veterinarian's letter with such letter obtained at the purchaser's expense, and produced to breeder within ten (10) days of the date of sale. (Purchaser is to take said puppy to their own veterinarian within five (5) days of purchase for health check up.) *Puppies receive beginning inoculations to consist of: 5 way shots (quantity depending on puppy's age when leaving breeder's possession), kennel cough if old enough, and heart worm preventative prior to leaving. Nemex 2 is given for treatment/prevention of round worm. 

2) All puppies are warranted against Progressive Retina Atrophy (PRA). Purchaser agrees to have said puppy seen by a board certified Opthamologist Veterinarian for eye exams at 1 year, 2 years and every 2 years there after until the age of 7, whereupon Purchaser agrees to have the eye exam done yearly. This information will be photocopied and sent to breeder for their records. If the animal referred to herein develops this condition before the age of 24 months, breeder at their option, shall either provide a replacement puppy as soon as a litter becomes available or refund the original purchase price (this is provided that breeder receives a signed veterinarian's letter, with such letter obtained at the purchaser's expense and return of said puppy). If purchaser does not wish to return said puppy a portion (50%) of purchase price will be refunded if purchaser does not wish to receive a replacement puppy. *Before any refund or replacement is given, a veterinary spay/neuter certificate stating that the puppy has been rendered incapable of reproducing, MUST be received by breeder (this is to protect the health of the breed). 

3) All puppies will be BAER tested before reacing 2 years of age and all test result paperwork will be copied and sent to breeder.

4) Said puppy is being sold on a Co-Ownership with the purchaser and breeder agreeing to allow breeder use of males for stud service if breeder wishes. Bitches to be bred with agreement to both parties and neither shall be bred without permission from breeder. Concerning male puppies, any future stud fees shall be payable to the purchaser. Breeder's co-ownership will be surrendered upon approved spay/neutering of said puppy or upon completion of agreement set forth. 

 (A) Purchaser has full rights to showing, racing, coursing, obedience or any competitive activity. Breeder has the right to show, race and/or course said puppy IF arrangements in ADVANCE are made and are not inconvenient to purchaser of said puppy. Breeder has first option to have said puppy for all AWC National events. All entry fees and advertising will be purchaser's responsibility, breeder will not run advertising or enter said puppy prior to agreement with purchaser. 

 (B) Purchaser agrees to NOT spay/neuter this puppy without WRITTEN permission in advance from breeder.

 * This puppy, nor any of its offspring, will be sold to a: Puppy Mill; Pet Store; Pet Broker or any such entity! If this occurs, breeder has the right to remove said puppy AND offspring without permission and damages will be filed against Purchaser.

 * This puppy, nor any of its offspring, will knowingly be placed in a any:  Pound, Animal Shelter, SPCA, Rescue, or any such group/organization. If this occurs, breeder has the right to said puppy and damages will be filed against Purchaser.

 (A) If this puppy is a bitch: Purchaser and breeder agree to co breed any litter(s), and one of these arrangements will be agreed upon prior to breeding: 

  - 1 - the purchaser will be responsible for all costs incurred of breeding of said puppy, breeder will help in locating an appropriate stud. All puppies/litters from said puppy (two [2] litters maximum) will be the property of Purchaser with breeder listed as co breeder, with a single whelp from one of said breedings being returned to breeder as final and complete payment for said bitch whereupon said co ownership will be completed, or 

  - 2 - breeder and Purchaser will co breed and split all costs incurred evenly with Purchaser at which time the litter will be split with breeder taking all odd number pick whelps, all even pick whelps shall be the purchaser's, or 

- 3 - breeder will be sole breeder, responsible for all occurring costs, selecting of stud and all whelps will be property of breeder. 

- a - Said bitch will be on co ownership until completion of co ownership or at which time she is spayed (after agreed upon by both Purchaser and breeder). 

- b - All whelps from said bitch will be put into homes that both Purchaser and breeder agree upon, meet and screen. No puppy will be placed into a home that either party has not had the opportunity to meet or speak with.

 (B) Bitches will not be bred until: 

- 1 - the puppy is a minimum of two (2) years of age, and 

- 2 - is examined by a qualified Veterinary Ophthalmologist and found to be CERF normal and a copy of CERF paperwork is sent to breeder and to CERF Headquarters, and, 

- 3 - has no disqualifying faults as defined by the AKC Whippet breed standard (over or under height by 1/2" or more, undershot or overshot by 1/4" or more, etc.), and, 

- 4 - the puppy fits the AKC standard developed for the Whippet breed, and, 

- 5 - the puppy having a stable and suitable temperament and health for breeding, and, 

- 6 - all testing will be done prior to breeding: vaginal screening/venereal disease, infections, internal parasites, CERFed Clear, von Willebrand tested, etc. *NO dog shall be accepted/NO bitch shall be bred unless said tests have been ran and results/paperwork has been received.

 (C) If this puppy is a dog: 

- 1 - Purchaser and breeder agree to allow breeder to 2 (two) stud services with a bitch owned or co owned by breeder or one of their family members whereupon the co ownership will be complete, and 

- 2 - Any and all bitches to be bred to said dog will be at the approval of both breeder and purchaser, and 

- 3 - Servicing of bitches shall be at the home of said male and purchaser unless agreed upon prior to dog being sent to a bitch, and 

- 4 - All Stud Fees are payable to the purchaser, NOT breeder, and 

 - 5 - All Bitch owners must be required to sign a Stud agreement which will state that all information about said whelps (to include but not limited to number/sex of whelps, overall health, record of cryptorchids produced, any and all health information) will be supplied to purchaser and breeder. In addition, a copy of all puppies’ contracts (including those kept by dam owner) will be made available to purchaser and breeder since we believe that not only is the dam’s owner(s) responsible for the said litter, but also so is/are the owner(s) of the stud.

 (D) Dogs will not be bred until: 

 - 1 - the puppy is a minimum of one (1) year of age, and 

 - 2 - is examined by a qualified Veterinary Ophthalmologist and found to be CERF normal and a copy of CERF paperwork is sent to breeder and to CERF Headquarters, and, 

- 3 - has no disqualifying faults as defined by the AKC Whippet breed standard (over or under height by 1/2" or more, undershot or overshot by 1/4" or more, has two healthy descended normal testicles, etc.), and, 

- 4 - the puppy fits the AKC standard developed for the Whippet breed, and, 

- 5 - the puppy having a stable and suitable temperament and health for breeding, and, 

- 6 - all testing will be done prior to breeding: vaginal screening/venereal disease, infections, internal parasites, CERFed Clear, von Willebrand tested, etc.

6) breeder shall immediately, upon receiving full payment for the sale, take the necessary actions to provide the purchaser with an American Kennel Club certificate of registration for the puppy on which is recorded the transfer of ownership to the appropriate parties for the purchaser to send in to the AKC. 

7) All puppies are sold subject to: 

 (A) the purchaser agreeing to assume full responsibility, including but not limited to financial responsibility, for the puppy both physically and mentally, to include regular contact with people and exposure to the outside world, with adequate facilities, including a fenced yard or proper sized exercise area, will not be confined by the use of chains or "tie-outs." (puppy MUST be a part of the purchaser's family to not be excluded from their life NOT a Kennel Dog), will not be kept in a crate or room without proper free time, will be fed a high quality food (we feed BilJac, Diamonds, Blackwood, or Authority, please avoid anything with SOY products as an ingredient or foods high in Corn or Corn products as well as Ethoxiquin and BHA/BHT preservatives as these are known cancer causing agents), said puppy will receive proper training, grooming, and veterinary care while said puppy is with purchaser; and, 

 (B) the purchaser agrees to keep in contact with breeder as to the progress of the puppy via e-mail, telephone or us postal service with letters and photos when possible; and allow home checks when possible, and 

 (C) should the purchaser, AT ANY TIME, be unable to keep the puppy in question, said puppy MUST be returned to breeder's ownership, accompanied by its appropriate signed registration papers unaltered, and 

 (D) puppy shall not be sent with any "handler" unless prior approval by breeder and purchaser. 

 If said puppy is returned to breeder, Purchaser is responsible for getting said puppy back to breeder at the Purchaser's own cost. If breeder has to pay for this, Purchaser will be billed for it. 

 If Said puppy is returned to breeder, we will either; 

- 1 - decide to keep the puppy for its breeding/showing program, in which case breeder will give a replacement puppy, or pay 100% of purchase price if returned within 2 wks; 50% of purchase price if returned within 1 month; No moneys will be returned after one year but a replacement puppy will be offered. *If said puppy has a genetic health problem as mentioned above,a replacement will be offered to Purchaser at no cost 

- a - At no time will breeder be responsible for more monies than the original purchase price of the puppy. All moneys are dependent upon condition of puppy at time of return. If said puppy is returned after one year of age, (and in good health and condition) purchaser can receive a replacement puppy when one becomes available if they chose. 

- 2 - decide (on the basis of condition, conformation and temperament) to spay/neuter the puppy and place him/her in a pet home, in which case breeder will give a replacement puppy, or pay 100% of purchase price if returned within 2 wks; 50% of purchase price if returned within 1 month; No moneys will be returned after one year but a replacement puppy will be offered. or 

- 3 - resell the puppy to a suitable home, in which case all expenses incurred (to include all costs involved in advertising) will be deducted from the selling price and the difference refunded to the original purchaser (100% of purchase price if returned within 2 wks; 50% of purchase price if returned within 1 month; No moneys will be returned after one year but a replacement puppy will be offered.

9) As used herein the term "AKC" stands for "American Kennel Club," "PRA" stands for "Progressive Retina Atrophy," "Proper Diet" refers to a top quality canine food (or Raw Diet) and supplements (with Vitamin E being an acceptable preservative). 

"Proper Veterinary Care" refers to, but not limited to, inoculations, internal as well as external parasites (Flea prevention: Mycodex spray, Ovitrol spray, Advantage are sighthound approved), YEAR ROUND Heartworm Preventative medication MUST be used (Interceptor, Heartgard, and Sentinel are approved for sighthounds), 
"Proper Grooming" refers to, but not limited to, maintaining the coat in a clean, healthy condition, and all items associated with grooming such as nail trimming, teeth cleaning, etc.

 *VIOLATIONS OF THE CONTRACT SHALL ENTITLE BREEDER TO FIVE THOUSAND DOLLARS ($5,000.00) IN LIQUIDATED DAMAGES AND ALL COSTS INCURRED OF SEIZURE OF PUPPY, AND THE PHYSICAL SEIZURE OF THE ABOVE NAMED WHIPPET, WITH OR WITHOUT THE PRESENCE OF THE POLICE OR HUMAN SOCIETY WHICHEVER THE SITUATION DICTATES.

  **Upon noncompliance of this contract all court proceedings will be in the state of Indiana and in the county of which breeder resides. Purchaser will be responsible for their availability to said court(s). The purchaser will be responsible for all court and attorney costs incurred by breeder for any and all noncompliance on the part of the purchaser. This is a legal and binding contract upholdable in any U.S. Court of Law. All parties to this agreement as witnessed by their signatures below have read, and understood all of the terms and conditions as set out herein.
